The Öko Institut has published its final report on the review of 11 RoHS exemptions titled “Assistance to the Commission on Technological Socio-Economic and Cost-Benefit Assessment Related to Exemptions from the Substance Restrictions in Electrical and Electronic Equipment (RoHS Directive)”. 7 of the 11 requests with final recommended words are recommended granting exemptions by Öko with proposed expiry dates.
The report’s introduction explains the exemption procedure and the relationship with REACH. If a substance is a REACH SVHC or listed in Annexes XIV or XVII, and exemptions must be consistent with any REACH obligations. Substances listed in the registry of intentions are also considered in the exemption review. Conflicts with the REACH regulation were considered by Öko for all of the exemptions that were considered.
So far, the Commission has not adopted any revision of the Annex to Directive 2011/65/EU based on these recommendations. In the past the Commission has generally respected their recommendations. It will probably be about a year before these exemptions are published in the Official Journal.
